Terms of Service

These Terms of Service ("Terms") govern your access to and use of the TreasureRate.com website, marketplace, AI agents, and related services (collectively, the "Service") operated by TreasureRate.com ("TreasureRate", "we", "us", or "our"). By creating an account, purchasing a subscription, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. The Service

TreasureRate.com is a marketplace of specialized AI agents and tools that help automate business and personal tasks. We may add, modify, or remove agents, features, and pricing at any time. Some features rely on third-party artificial intelligence models and may produce outputs that are generated automatically.

2. Accounts & Eligibility

• You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.
• You are responsible for the accuracy of your account information and for keeping your credentials secure.
• You are responsible for all activity that occurs under your account.
• Notify us promptly of any unauthorized use of your account.

3. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation, or infringe the rights of others.
• Generate or distribute unlawful, harmful, deceptive, harassing, or infringing content.
• Attempt to reverse engineer, scrape, overload, or disrupt the Service or its infrastructure.
• Resell, sublicense, or misrepresent the Service or its outputs as your own proprietary technology where prohibited.
• Submit sensitive personal, financial, or confidential data to agents except as intended and at your own risk.

4. AI Outputs & No Professional Advice

AI agents generate content automatically and may be inaccurate, incomplete, or unsuitable for your specific situation. Outputs are provided for informational and productivity purposes only and do not constitute legal, financial, tax, medical, or other professional advice. You are solely responsible for reviewing, verifying, and deciding how to use any output before relying on it.

5. Subscriptions, Billing & Payments

• Paid agents, bundles, and packs may be offered on weekly, monthly, yearly, lifetime, or one-time terms.
• Payments are processed securely by our third-party payment processor (Stripe). We do not store full card details.
• Recurring subscriptions renew automatically at the then-current price until cancelled, and you authorize us (via Stripe) to charge your payment method each cycle.
• Prices, taxes, and fees may change; we will provide notice of material changes where required.

6. Free Live Demos

Certain agents may be available to try live for free, subject to usage limits. These demos are provided "as is" and may be modified or discontinued at any time.

7. Promotions, Referrals & Account Credit

We may offer promotions, referral rewards, and account credit (including launch promotions such as the "Founders Sale"). Such offers are subject to their stated conditions and these Terms. Account credit and promotional discounts have no cash value, are non-transferable, may expire, and may be limited in quantity or to eligible customers. We may modify or end any promotion, and may revoke rewards obtained through fraud, abuse, or error.

8. Cancellations & Refunds

You may cancel a subscription at any time; cancellation takes effect at the end of the current billing period and you retain access until then. Except where required by law, payments are generally non-refundable. If you believe you were charged in error, contact us and we will review your request in good faith.

9. Intellectual Property

The Service, including its software, branding, logos, and content (excluding your inputs and lawful outputs you generate), is owned by TreasureRate or its licensors and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. Subject to your compliance and payment, you own the outputs you lawfully generate for your own use.

10. Your Content

You retain ownership of the inputs and content you submit. You grant us a limited license to process that content as necessary to operate and improve the Service. You represent that you have the rights to submit such content and that it does not violate any law or third-party right.

11. Third-Party Services

The Service integrates third-party providers (for example, AI model providers and payment processors). Your use of those features may be subject to the third parties' own terms, and we are not responsible for their acts or omissions.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the Service or any AI output will be uninterrupted, error-free, or meet your requirements.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TREASURERATE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

14. Indemnification

You agree to indemnify and hold TreasureRate harmless from any claims, damages, or expenses arising out of your use of the Service, your content, or your violation of these Terms or applicable law.

15. Termination

We may suspend or terminate your access if you violate these Terms or use the Service in a way that may cause harm or legal exposure. You may stop using the Service at any time. Sections that by their nature should survive termination will survive.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with a new "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance.

17. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. Disputes will be subject to the exclusive jurisdiction of the state and federal courts located in California, except where applicable law provides otherwise.
